On-Island Agent & Licensing Requirements for Off-Island Owners

If you live off-island or out of state and rent your Oʻahu property, Hawaiʻi law requires you to name an on-island agent to provide a local contact that guests and inspectors can easily reach. In most cases, if that person manages property for more than one owner, they must also hold an active Hawaiʻi real estate license.

What the law requires

  • On-island agent (same island as the unit) is required and must be disclosed to the guest. See HRS §521-43(f).
  • Local contact info (name, phone, email) must be conspicuously displayed at the property alongside TAT registration or otherwise disclosed to the guest. See HRS §237D-4(b)/(c) and HAR §18-237D-4-08.
  • Guest payments = rent: Payments you receive for lodging and hosting guests are considered rent as defined by HRS §237D-1 ("Gross rental" or "gross rental proceeds"). This ties to Hawaiʻi’s transient accommodations, local point of contact, and real estate licensing requirements.
  • Managing “for others” (more than one owner) is a real estate brokerage activity that usually requires an active Hawaiʻi real estate license. See HRS §467-1(Real estate broker).
  • Limited employee exception: a custodian/caretaker employed as an employee by a single owner may manage only that owner’s properties. The appointed custodian/caretaker cannot manage property for any other owner. This is defined by HRS §467-1(Custodian or caretaker).

What the “single-owner employee” exception looks like (examples)

  • Employee caretaker (allowed): You hire Alex as a W-2 employee (or equivalent) to manage only your condo(s). Alex does not manage for any other owner. This fits the custodian/caretaker exception.
  • Independent cleaner/repair-tech (not allowed): Jamie owns a cleaning/repair business that services many owners. Jamie is an independent contractor, not your employee. Jamie is not covered by the caretaker exception. Management for multiple owners generally requires a Hawaiʻi real estate license. Jamie could only qualify if designated as your local representative with proper disclosures made to guests, strictly performing cleaning/repairs and servicing only your property(s). Jamie cannot serve other owners and must be considered your Employee in accordance with the State of Hawaii.
  • Cohosting multiple owners (not allowed, real estate license required): Samantha “cohosts” on Airbnb/VRBO for several owners and does not have an active Hawai'i real estate license. Handling messages, bookings, pricing, and turnovers. This is property management for others across multiple owners, which requires a Hawaiʻi real estate license.
  • One owner, multiple units (allowed): Pat is a full-time employee of one owner who holds several units. Pat may manage those units for that single owner only.

Note: Titles like “cohost,” “concierge,” or “assistant” don’t change the rule. The activity and number of owners determine if a license is required.

Non-compliance can lead to investigations, fines, and advertising takedowns. More importantly, it puts guests and neighbors at risk when no qualified local contact is available.

Good to know

Vacation, short-term, and mid-term rentals are generally treated as a business activity in Hawaiʻi. That means owners are expected to understand and follow applicable laws and tax rules. While every case is unique, leniency is not guaranteed, and non-compliance can affect your advertising, bookings, and reputation. We help owners stay on track with licensed, on-island management.
