These Terms of Use (“Terms”) govern access to and use of happyvacationshawaii.com (the “Site”), which is operated by Happy Vacations LLC (“Happy Vacations,” “we,” “us,” or “our”), certain website-related features and communications, and, where applicable, Happy Vacations text messaging programs described in these Terms. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Scope of These Terms

These Terms apply to use of the Site and website-related features, including web chat, forms, online information, and communications made available through or in connection with the Site. The text messaging provisions in these Terms also apply, where applicable, to Happy Vacations text messaging programs, including messages relating to inquiries, reservations, stays, services, transactions, offers, or other communications described below, regardless of whether the underlying reservation or relationship originated through the Site or through another booking or communication channel.

These Terms do not replace or modify any Guest Rental Agreement, property management agreement, booking confirmation, platform agreement, or other separate agreement that applies to a reservation, property, service, purchase, or other transaction. If a separate agreement applies and conflicts with these Terms regarding that subject matter, the separate agreement controls.

2. Eligibility and Website Use

You must be at least 18 years old to make a reservation, make a purchase, or enter into another binding agreement through the Site.

You may use the Site only for lawful purposes and in a manner that does not interfere with the Site, its security, or the rights of others.

3. Reservations, Services, and Other Transactions

The Site may provide information about vacation rentals, furnished rentals, property management services, availability, rates, optional services, and other offerings. Information displayed on the Site may change and may be subject to availability, confirmation, and applicable separate agreements.

Reservations and stays are subject to the applicable Guest Rental Agreement, booking confirmation, and any applicable booking-platform terms. Property management and other professional services are subject to the separate agreements applicable to those services. Cancellation, refund, payment, stay, and property-specific terms are governed by those applicable agreements rather than these website Terms.

4. Website Information and No Professional Advice

We may provide general information about vacation rentals, property management, real estate, taxes, regulations, maintenance, travel, and related topics. Website content is provided for general informational purposes and is not legal, tax, accounting, financial, construction, engineering, or other professional advice. You should consult an appropriately qualified professional regarding matters requiring professional advice.

Website information may not reflect the most current law, regulation, pricing, availability, property condition, or other circumstances. Binding terms for a reservation or service are determined by the applicable confirmation or separate agreement.

5. AI and Automated Communications

Happy Vacations may use artificial intelligence and other automated technologies to assist with web chat, guest communications, responses to inquiries, service support, and other business functions. Some communications may be generated, suggested, routed, or assisted by automated systems.

Automated or AI-assisted responses may contain errors, omissions, or outdated information. They do not amend a Guest Rental Agreement, property management agreement, booking confirmation, or other binding agreement. Do not rely on web chat or automated communications as a substitute for emergency services or professional legal, tax, medical, safety, or other professional advice. For a life-threatening or immediate safety emergency, call 911 or the appropriate emergency service.

6. Text Messaging Terms

Happy Vacations Text Messaging Program. Happy Vacations may use text messaging in connection with inquiries, reservations, stays, guest support, service or maintenance matters, transactions, optional services or offers associated with a reservation or other relationship, and promotional or marketing communications, in each case as permitted by applicable law and subject to any consent that may be required.

When you affirmatively opt in to a Happy Vacations text messaging program, you agree to receive the categories of messages described at the point of opt-in at the mobile number you provide. We may also use a telephone number provided in connection with an inquiry, reservation, stay, or other existing relationship to communicate about that matter as permitted by applicable law.

Message frequency varies. Message and data rates may apply. Consent to receive marketing text messages is not a condition of purchasing or receiving services from Happy Vacations.

Reply STOP to cancel recurring text messages from the applicable messaging program. We may send one final message confirming your opt-out. Reply HELP for help, or contact Happy Vacations at info@happyvacationshawaii.com or (808) 800-4599.

Wireless carriers are not liable for delayed or undelivered messages. If your mobile number changes, please update the contact information associated with your inquiry, reservation, or messaging preferences.

Opting out of text messages does not prevent Happy Vacations from communicating with you through other channels, such as email, booking-platform messaging, or telephone, when permitted by applicable law and relevant to your inquiry, reservation, transaction, service, or other relationship with us.

7. Payments and Third-Party Services

The Site may link to, integrate with, or make available services provided by third parties, including booking platforms, reservation systems, payment processors, communications providers, maps, guest or owner portals, and other technology providers. Separate terms and privacy policies may apply when you interact with those services.

Happy Vacations does not control independent third-party websites or services and is not responsible for their availability, content, security, or practices except to the extent responsibility cannot be excluded under applicable law. Payment, cancellation, refund, and reservation obligations remain subject to the agreement applicable to the particular transaction.

8. Intellectual Property

The Site and its content, including text, photographs, graphics, logos, designs, and other materials, are owned by or licensed to Happy Vacations and are protected by applicable intellectual property laws.

You may access and use Site content for your personal, lawful, noncommercial use. Except as permitted by law or with our prior permission, you may not reproduce, distribute, modify, publish, sell, or commercially exploit Site content.

9. Prohibited Uses

You may not use the Site to:

  • violate applicable law or the rights of another person or entity;
  • impersonate another person, provide fraudulent information, or engage in fraudulent or deceptive activity;
  • introduce malware, malicious code, or other harmful material;
  • attempt to gain unauthorized access to the Site, accounts, systems, networks, or data;
  • interfere with or disrupt the operation, security, or availability of the Site; or
  • use automated tools or processes in a manner that circumvents access controls, violates applicable law, or places an unreasonable burden on the Site or its systems.

This section does not prohibit ordinary search-engine indexing or other automated access that Happy Vacations authorizes or permits.

10. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and website content are provided on an “as is” and “as available” basis. Happy Vacations does not warrant that the Site will always be available, uninterrupted, secure, error-free, or that all website content will always be complete, current, or accurate.

This section does not disclaim any warranty, obligation, or right that cannot lawfully be disclaimed, and it does not modify express obligations contained in a separate agreement with Happy Vacations.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Happy Vacations and its officers, employees, agents, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from or relating to use of, inability to use, or reliance on the Site or website content.

This limitation does not alter liability or remedies governed by a separate Guest Rental Agreement, property management agreement, booking-platform agreement, or other applicable agreement, and nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

12. Governing Law and Venue

These Terms and disputes arising from these Terms or use of the Site, excluding matters governed by a separate agreement, are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles.

Subject to any mandatory rights or jurisdiction that applicable law does not permit the parties to waive, disputes arising from these Terms or use of the Site will be brought in the state or federal courts located in the City and County of Honolulu, Hawaii.

13. Changes to These Terms

We may update these Terms from time to time. The current version will be posted on this page with an updated “Last Updated” date. Unless otherwise stated, revised Terms apply from the date they are posted. If applicable law requires additional notice of a material change, we will provide that notice as required.

Changes to these Terms do not modify a separate Guest Rental Agreement, property management agreement, or other separate agreement except in accordance with the terms of that agreement or as otherwise agreed by the applicable parties.

14. Severability and No Waiver

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law. A failure by Happy Vacations to enforce a provision of these Terms does not waive the right to enforce that provision later.
